1 Cancellations

Students may cancel a lesson by actual [written] notice to Fluent Language Tuition (“Fluent”) at least 24 hours in advance of the scheduled time for the lesson and Fluent will allow the Student to reschedule the lesson at no additional charge, subject to Fluent’s availablilty. If Fluent does not receive a cancellation notice at least 24 hours in advance or if the Student fails to appear for a lesson, Fluent shall have no obligation to reschedule a replacement the lesson. Students are not entitled to refunds for lessons, including pre-paid lessons, if the Student does not appear for the lesson or if Fluent receives notice of the cancellation less than 24 hours in advance. A Student who cancels a lesson at least 24 hours in advance may receive a full refund if the lesson is not rescheduled.  Notice is deemed to be given when it is actually received by Fluent, whether in writing, including email or text message, or by telephone call.

2 Lateness for lessons

Students should always be on time for lessons. Where a delay of up to 10 minutes or more is anticipated by the student, Fluent Language Tuition requires 30 minutes (half an hour) notice to be given in advance. Lessons will be rescheduled where possible. Where students are more than 10 minutes late to a lesson without prior notification, Fluent Language Tuition reserves the right to cancel the lesson without refund.

3 Limitations of delivery of online lessons

All online lessons are delivered subject to connection quality and adequate connection speed as well as the availability of the software packages agreed upon by Fluent Language Tuition and the student. Should the delivery of an online lesson be abandoned for technical reasons, Fluent may, in Fluent’s discretion, add up to 20 minutes of teaching time to the subsequent lesson. Unless otherwise agreed, it is not possible for students to claim any refunds for pre-paid lessons citing the connection quality or speed, as this will have been ascertained and deemed acceptable during the trial lesson period.

4 My cancellations

Fluent Language Tuition always strives to be available for all of the scheduled lessons, but will strive to provide advance notice of any cancellations. In the event that Fluent cancels a lesson, whether or not notice is given, the lesson will be rescheduled. In extenuating circumstances, advance notice of cancellation by Fluent Language Tuition may not be possible and students must accept lessons may need to be cancelled on the same day of the lesson.

5 Regular Lesson Slots

Fluent is dedicated to providing students with regular lesson slots, but please note that availablilty is not guaranteed. Fluent will make good faith efforts to accommodate such requests, but the lack of availability for a preferred slot is not an acceptable reason for a refund.

6 Sharing lessons with Third Parties

1 to 1 lessons can only be for one person at one time. As lessons are tailored to the individual, they may not be shared with a third party. Each new student will be required to contact Fluent and arrange to purchase a new lesson for his or her own benefit.

7 Refunds

Refunds for lessons will be given only in accordance with the cancellation terms above.

8 Payment Terms

Invoices for all lessons are payable in advance using the cited payment methods, and students will receive an invoice to confirm the date of agreement. Fluent reserves the right to cancel any lessons after the first paid lesson at any time until payment is received in full by Fluent for additional lessons.

Monthly Rates

Students taking advantage of the monthly deal lessons will be automatically invoiced for the set amount every month. Your monthly invoice amount is fixed and covers the cost of an agreed amount of sessions. Students wishing to cancel their monthly lesson plan must do so by notice to Fluent at least 10 working days before the next invoice is due. If the required notice is not given, the student will be liable for payment in full of the next month’s invoice.

9 Limited Liability

Fluent makes no representations or warranties regarding the results that students may achieve as a result of hiring Fluent as a teacher. Fluent shall have no liability for a student’s failure to achieve desired goals or to attain the student’s desired results while studying with Fluent as a teacher.

10 Copyright of materials

Fluent retains the copyright of all tuition materials and recorded lessons provided unless otherwise stated. Tuition materials may be used freely for educational, non-commercial purposes only. All materials used must be accredited to Fluent. Organisations and individuals wishing to use such material for any other purpose should contact Fluent.

Disputes and Definitions

Please note that Fluent Language Tuition is the trading name of Kerstin Cable (née Hammes) and based in Lancaster, UK. Any disputes arising between students of Fluent Language Tuition and Kerstin Cable shall be governed by the laws and jurisdiction of the courts of England and Wales.

Changes to these Terms and Conditions

Fluent reserves the right to change, modify, revise or otherwise amend any provision of these Terms and Conditions, and any other terms, policies or guidelines governing tutoring services provided by Fluent, at any time at Fluent's sole discretion by providing notice that the Terms of Use have been modified. Such notice may be provided by sending an email, or by posting a notice on Fluent's website (http://fluentlanguage.co.uk) (the "Site"), or by posting the revised Terms and Conditions on the Site and revising the date at the top of these Terms and Conditions or by such other form of notice as determined by Fluent. Your continued use of tutoring services or your purchase of any tutoring services following the posting of the revised Terms and Conditions or other notice will constitute your acceptance of such changes or modifications. Otherwise, any changes or modifications will be effective within thirty (30) days of the posting of the revisions on the Site unless you notify Fluent within such thirty 30 days that you do not agree to the changes and stop using Fluent's services. Therefore, you should review these Terms and Conditions regularly (at least every 30 days) to make sure that you understand the terms and conditions that will apply to your use of tutoring services.
